What considerations are taken into account when determining which parent a child should live with and time spent with the other parent?

When deciding which parent a child should live with and how much time they should spend with the other parent, the Court makes an overall assessment on what is in the child’s best interest giving consideration to various factors such as: the need to protect the child from family violence, harm, abuse, or neglect; the child’s right to have a meaningful relationship with both parents; their relationship with each parent; the ability of each parent to meet the child’s needs, their emotional and physical wellbeing; the child’s views expressed and factors such as the child’s maturity and level of understanding and any other relevant considerations based on the individual circumstances of the case.
